The Desert Hills Fire District Auxiliary (“Auxiliary” or “Sponsor”) is recognized by the Internal Revenue Service as a 501(c)(3) public charity. DHFDA Tax Exempt letter
The Auxiliary has existed and operated in Arizona for more than one year and is conducting this Raffle pursuant to the charitable-raffle provisions of A.R.S. § 13-3302(B).
The Raffle is being conducted to raise funds in support of the charitable mission of the Desert Hills Fire District Auxiliary.
Proceeds may be used to support projects and needs benefiting Desert Hills Fire District and the community, including firefighter training resources, forcible-entry training props, rescue and extrication equipment, firefighter protective equipment, station and apparatus-bay improvements, public-safety programs, community programs, and other charitable projects approved by the Auxiliary.
No member, director, officer, employee, or agent of the Auxiliary will receive a direct or indirect financial benefit from the Raffle except that an otherwise eligible person may participate in the Raffle on the same basis as all other participants, as permitted by Arizona law. Raffle ticket sales will begin on:
October 1, 2026
and will end on:
December 12, 2026
Ticket sales on December 12 will close immediately before the Sponsor begins the drawing. Only completed, paid, valid raffle-ticket transactions recorded in the Sponsor’s official raffle records before the drawing begins will be eligible.
The Sponsor may establish an earlier sales cutoff on December 12 if reasonably necessary to reconcile ticket records and prepare for the drawing. Any earlier cutoff will be clearly posted on the official Auxiliary website and/or at the drawing location before the cutoff occurs.
Raffle tickets are:
Each $20 purchase represents one raffle entry and one unique raffle ticket number.
No complimentary raffle tickets, special member tickets, or preferential entries will be issued.
The odds of winning depend on the total number of valid raffle tickets sold.
A purchaser must be physically located within the State of Arizona at the time the raffle ticket is purchased.
Arizona residency is not required. A person who resides outside Arizona may purchase a ticket while physically present within Arizona, provided all other eligibility requirements are satisfied.
An Arizona resident who is physically outside Arizona at the time of an online purchase is not eligible to make that purchase.
Arizona Department of Gaming guidance for charitable raffles states that online purchases should be limited to individuals located in Arizona and that online sales should be through the organization’s website operated by members of the organization. Arizona Gaming
By submitting an online raffle-ticket purchase, the purchaser certifies that he or she is physically located within Arizona at the time the transaction is completed.
The Sponsor may use purchaser certifications, transaction information, payment records, or other reasonable information to verify compliance. A purchase determined to have been made while the purchaser was physically outside Arizona may be declared void. If practicable, the ticket purchase price will be returned to the original purchaser.
Participants must:
Be 18 years of age or older at the time of purchase;
Be physically located in Arizona when purchasing the ticket;
Provide accurate contact information;
Submit valid payment; and
Comply with these Official Raffle Rules.
Membership in the Auxiliary does not by itself prevent an otherwise eligible person from purchasing a ticket or winning the prize.
Members, directors, officers, employees, and agents of the Auxiliary may participate only on the same basis as all other participants, with no free tickets, preferential treatment, increased odds, advance knowledge, or other direct or indirect financial advantage. This reflects the participation exception contained in A.R.S. § 13-3302(B)(1). Arizona Legislature
The Raffle is sponsored, controlled, administered, and overseen by the Desert Hills Fire District Auxiliary.
Consistent with A.R.S. § 13-3302(B)(3), persons participating directly or indirectly in the management, sales, or operation of the Raffle on behalf of the Sponsor will be bona fide local members of the Auxiliary, except to the extent a technology or financial service is lawfully used to facilitate transactions. Online raffle-ticket purchases will originate through the Desert Hills Fire District Auxiliary’s website.
The Auxiliary uses Zeffy as its technology/payment and ticketing platform. Zeffy may:
Process electronic payments;
Collect purchaser information;
Record the transaction;
Generate or assign raffle ticket numbers; and
Provide purchase/ticket confirmation to the purchaser.
The Auxiliary remains the sponsoring organization and retains control and oversight of the Raffle and the drawing.
Purchasers are responsible for ensuring that the email address, telephone number, name, and other information submitted with the purchase are accurate.
A transaction is not a valid raffle entry until payment has been successfully completed and the ticket is recorded in the Sponsor’s raffle records.
Transactions that are declined, reversed, charged back, fraudulent, canceled, or otherwise not successfully paid may be declared void.
Any voluntary contribution or tip made to Zeffy or any separate charitable donation is not a raffle-ticket purchase and does not increase a purchaser’s number of raffle entries unless it is specifically processed as the purchase of additional raffle tickets.
The Auxiliary may also sell raffle tickets in person.
In-person ticket sales will be conducted by bona fide Auxiliary members.
For cash purchases, an authorized Auxiliary member will record the transaction, assign the appropriate ticket number or numbers, record the purchaser’s required contact information, and provide a ticket, receipt, or other confirmation when applicable.
Cash entries will be incorporated into the same official raffle record used for online entries so that every valid ticket receives an equal opportunity to be selected.
The Raffle prize is:
Approximate Fair Market Value: $29,980
The stated fair market value is an estimate made in good faith and may differ from the actual market value of the vehicle at the time of transfer.
Except for the Sponsor’s obligations expressly stated in these Rules, the UTV will be transferred to the winner in its then-existing condition, AS-IS and WHERE-IS, without warranties by the Auxiliary, except for any manufacturer or other warranty that may independently remain valid and be transferable.
No difference between the stated approximate value and actual market value will be paid to the winner.
There is no cash alternative to the prize except as specifically provided in the Prize Unavailability and Unforeseen Circumstances section below.

One valid raffle ticket will be randomly drawn from all eligible raffle entries.
Each valid raffle ticket will have an equal opportunity to be selected.
The winner does not need to be present to win.
The Bunker Bar is the planned drawing venue and is not the sponsor of the Raffle.
If weather, venue availability, emergency conditions, public-safety concerns, governmental action, cancellation or modification of the Annual Toy Drive, or another circumstance beyond the Sponsor’s reasonable control prevents the drawing from being conducted as planned, the Auxiliary may move the drawing to another location within Arizona and/or reasonably reschedule the drawing.
Any material change will be announced through the Auxiliary’s official website and other reasonable communication channels.
Such a change will not alter the validity of properly purchased raffle tickets.
The potential winner will be contacted using the telephone number, email address, or other contact information provided with the winning entry.
Purchasers are responsible for providing accurate contact information.
The Sponsor will make reasonable documented attempts to contact the potential winner.
The potential winner will have 30 calendar days from the Sponsor’s first notification attempt to respond, establish eligibility, provide required identification and tax information, and cooperate with the prize-transfer process unless the Sponsor grants a reasonable written extension.
Before the prize is transferred, the potential winner must:
Establish that the winning ticket was validly purchased;
Confirm compliance with the Arizona physical-presence requirement;
Provide proof of identity;
Provide a valid taxpayer identification number;
Complete any required IRS forms;
Provide any additional information reasonably required for tax reporting;
Sign required prize-acceptance, title-transfer, receipt, and release documents; and
Cooperate with Arizona title and registration requirements.
For reportable sweepstakes, lottery, and charity-raffle winnings, current IRS instructions require identifying information and generally require two forms of identification, with at least one containing a photograph. IRS
The person whose valid ticket is selected is only a potential winner until eligibility and compliance with these Rules are verified.
A potential winning ticket may be declared invalid if the Sponsor reasonably determines that:
The ticket was purchased while the purchaser was physically outside Arizona;
Payment was declined, reversed, fraudulent, or charged back;
The purchaser was not eligible;
Materially false information was provided;
The ticket was altered, duplicated, manipulated, or fraudulently created;
The purchaser fails to provide required tax or identification information;
The purchaser fails to respond within the required claim period; or
The purchaser otherwise materially violated these Official Rules.
If a selected ticket is declared invalid or the winner forfeits the prize, the Sponsor will conduct another random drawing from the remaining valid entries.
The Sponsor’s official raffle records will control in resolving questions regarding ticket ownership, payment status, ticket numbers, or eligibility.
If a duplicate ticket number, technical error, illegible record, or other administrative problem is discovered before the drawing, the Sponsor may correct the record or issue a replacement number in a manner that preserves each valid purchaser’s equal chance of winning.
If an irregularity affects the selected winning entry, the Sponsor may investigate the matter before awarding the prize and, if necessary, conduct an additional random drawing.
The UTV is a noncash gambling prize for federal tax-reporting and withholding purposes.
Because the prize substantially exceeds the applicable federal threshold, the Sponsor expects federal gambling withholding and reporting requirements to apply.
The Desert Hills Fire District Auxiliary has elected to pay the required federal gambling withholding associated with the noncash prize on behalf of the winner.
Current IRS instructions provide that when the payer pays the federal withholding associated with a noncash raffle prize, the withholding is calculated at 31.58% of the fair market value of the noncash prize minus the amount of the winning wager. The amount paid by the Sponsor on behalf of the winner is itself added to the winner’s reportable gambling winnings. IRS
Using the currently stated $29,980 fair market value and a $20 winning ticket as an example, the federal withholding paid by the Auxiliary would be approximately $9,461.37, subject to the final fair market value and federal tax law applicable when the prize is awarded.
The final amount will be calculated according to applicable IRS requirements at the time of transfer.
The Sponsor will prepare and issue Form W-2G, Certain Gambling Winnings, and make other required federal filings.
Current IRS instructions specifically state that the sweepstakes/lottery reporting rules apply to church raffles, charity drawings, and similar events. When a payer pays the withholding on a noncash prize, the prize value plus the withholding paid by the payer is included in the reportable winnings. The withheld tax is separately reported. IRS
The Auxiliary will also report and remit federal gambling withholding as required, including through Form 945, Annual Return of Withheld Federal Income Tax, when applicable. IRS
The Auxiliary’s commitment is to pay the required federal gambling withholding associated with the Raffle prize on behalf of the winner.
This does not mean that the Auxiliary is agreeing to pay every tax the winner may ultimately owe.
The winner remains solely responsible for:
Any additional federal income-tax liability;
Any Arizona or other state income-tax liability;
Any local tax liability;
Any tax liability arising from the winner’s individual circumstances; and
Any future tax or fee associated with ownership, registration, use, or disposition of the UTV.
The winner should consult his or her own qualified tax professional concerning individual tax consequences.
The Sponsor will cooperate with the winner in completing the lawful transfer of ownership of the UTV.
Unless expressly stated otherwise by the Sponsor, the winner is responsible for all expenses associated with taking possession and owning the UTV after the prize is awarded, including:
Arizona MVD title and registration fees;
OHV registration/decal requirements, if applicable;
Insurance;
Transportation;
Towing or hauling;
Licensing or permits;
Maintenance; and
Future operating expenses.
The winner is responsible for arranging pickup and transportation of the UTV from the location designated by the Auxiliary.
The Auxiliary is not responsible for transporting or shipping the UTV to the winner.
The winner is responsible for determining that he or she may lawfully possess, register, insure, transport, and operate the UTV.
After transfer and delivery, the winner assumes responsibility for the possession, transportation, storage, maintenance, operation, and use of the vehicle.
To the extent permitted by law, the winner may be required to execute customary title-transfer, prize-acceptance, receipt, and liability-release documentation before taking possession.
The Sponsor intends to award the specific 2023 Speed “El Jefe” UTV described in these Rules.
However, circumstances beyond the Sponsor’s reasonable control could make transfer of the specific vehicle impossible or unlawful. Examples include, without limitation:
Theft;
Fire;
Collision or catastrophic damage;
Destruction or total loss;
Previously unknown title or ownership defects;
Government seizure or governmental action;
Inability to obtain or transfer legally sufficient title;
Natural disaster;
Force majeure;
Legal prohibition;
Material casualty occurring before transfer; or
Another event beyond the Sponsor’s reasonable control that prevents lawful delivery of the vehicle.
If the Sponsor is unable to award the advertised UTV for such a reason, the Sponsor may, to the extent permitted by law:
First, attempt to provide a substitute prize having a fair market value equal to or greater than the advertised prize value.
If a reasonable equivalent substitute cannot be provided, the Sponsor may cancel the Raffle and refund the raffle-ticket purchase price paid by each identifiable purchaser.
If the drawing has already occurred when the inability to transfer the advertised vehicle is discovered, the Sponsor will first attempt to provide the verified winner with a lawful substitute prize of equal or greater fair market value. If a reasonable equivalent cannot be provided, the Sponsor may cancel the Raffle and refund the ticket purchase prices to the purchasers.
Any substitute prize will remain subject to applicable federal and state tax-reporting and withholding requirements.
Except where otherwise required by law, the Sponsor will not be responsible for consequential, incidental, speculative, or other damages arising solely from the cancellation or substitution of the prize.
The prize may be forfeited if the potential winner:
Is determined to be ineligible;
Purchased the winning ticket outside Arizona;
Cannot establish ownership of the winning ticket;
Fails to respond within the required period;
Refuses or fails to provide required taxpayer information;
Refuses to complete required title or tax documentation;
Materially violates these Rules; or
Declines the prize.
If the prize is forfeited, the Sponsor may conduct another random drawing from the remaining eligible tickets until an eligible winner is verified.
Raffle-ticket purchases are generally final and nonrefundable after a valid ticket number has been issued.
Refunds may be made when:
The Sponsor cancels the Raffle;
A transaction is voided because it was not legally eligible;
A processing error results in an unauthorized or duplicate charge;
The prize cannot be awarded and no reasonable substitute is available, as described above; or
A refund is otherwise required by law.
The Sponsor may publicly announce the winner’s name and city/state of residence in connection with the Raffle.
The Sponsor will not publicly post the winner’s Social Security number, taxpayer identification number, government identification numbers, or other sensitive tax information.
The winner acknowledges that the Sponsor may be required to disclose the winner’s name, address, taxpayer information, prize value, withholding information, and other information to the Internal Revenue Service, Arizona governmental authorities, financial institutions, title agencies, or other entities when reasonably necessary to comply with law or transfer the prize.
The Arizona Attorney General registration form provided to the Auxiliary states that the names and addresses of prize winners are to be submitted following the award under that registration process. gambling_registration_form
A bona fide Auxiliary member may assist with lawful raffle activities such as ticket sales, recordkeeping, promotion, money collection, purchaser assistance, and the drawing.
A member who otherwise satisfies these Official Rules may also purchase raffle tickets on the same basis as every other participant.
No member will receive special ticket pricing, free entries, enhanced odds, preferential selection, or other financial advantage because of membership or service to the Auxiliary.
Arizona law allows nonprofit insiders to participate in a raffle on the same basis as other participants while prohibiting them from receiving other direct or indirect pecuniary benefits. Arizona Legislature
The Sponsor will use a random drawing method intended to provide each valid ticket with an equal opportunity to be selected.
The drawing will be conducted under the supervision of bona fide members of the Desert Hills Fire District Auxiliary.
No person may intentionally manipulate, predetermine, influence, or otherwise interfere with the random selection of the winning ticket.
The Sponsor is not responsible for temporary internet outages, payment-platform interruptions, corrupted transmissions, email-delivery failures, telecommunications failures, or similar technical problems beyond its reasonable control.
If such an issue occurs, the Sponsor will make reasonable efforts to preserve valid purchases and accurately reconcile ticket records before the drawing.
A purchaser whose transaction was never successfully completed and recorded is not considered to have purchased a valid ticket.
The Sponsor may suspend, postpone, modify, or cancel the Raffle when reasonably necessary because of:
Changes in applicable law;
Governmental direction;
Court order;
Emergency conditions;
Fraud or suspected manipulation;
Material technical failure;
Loss or unavailability of the prize;
Venue cancellation;
Public-safety concerns; or
Other circumstances that make continuation illegal, unsafe, impracticable, or materially unfair.
The Sponsor will provide reasonable public notice of a material change through its official website or other appropriate communication method.
The Sponsor will not materially modify these Rules merely to disadvantage existing ticket purchasers after ticket sales begin.
Questions or disputes regarding ticket validity, purchaser eligibility, drawing procedures, or application of these Rules will be reviewed by the Desert Hills Fire District Auxiliary.
The Sponsor’s determination will be based upon the Official Rules, raffle records, applicable law, and the goal of providing fair and equal treatment to all participants.
All Sponsor decisions remain subject to applicable law.
The Raffle and these Official Rules are governed by the laws of the State of Arizona.
The Sponsor intends the Raffle to qualify for the charitable-raffle exclusion contained in A.R.S. § 13-3302(B). That statute requires qualifying §501 organizations conducting raffles to maintain nonprofit status, have existed continuously in Arizona for at least one year, prohibit improper pecuniary benefits, and restrict management, sales, and operation of the raffle to bona fide local members subject to statutory exceptions. The fact that the Auxiliary has communicated with an Arizona governmental agency or submitted a registration or other document must not be interpreted as an endorsement, approval, guarantee, or legal opinion by the State of Arizona or the Arizona Attorney General.
The Attorney General’s registration form expressly states that acceptance or rejection of the form does not mean the Arizona Attorney General or State of Arizona has reviewed, authorized, or approved the proposed activity. gambling_registration_form
By purchasing a raffle ticket, the purchaser acknowledges that he or she:
Has read or had the opportunity to read these Official Rules;
Meets the eligibility requirements;
Was physically located in Arizona when purchasing the ticket;
Understands that the purchase price is generally nonrefundable;
Understands the tax implications described above; and
Agrees to be bound by these Official Rules and applicable law.
